1. Copyright Infringement

topgservers respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform. If you believe that content hosted on or linked from topgservers infringes your copyright, please submit a DMCA takedown notice as described below.

2. Filing a DMCA Takedown Notice

To file a copyright infringement notification with us, send a written communication to our designated DMCA agent at [email protected]. Your notice must include the following five elements:

  1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed, or a representative list if multiple works are involved.
  2. Identification of the infringing material — The URL(s) or other specific identification of the material on topgservers that you claim is infringing, with enough detail for us to locate it.
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy and authority statement — A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

Your notice must be signed (physical or electronic signature) by the copyright owner or an authorised representative.

3. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us at [email protected]. Your counter-notification must include:

  • Your name, address, and telephone number.
  • Identification of the material that was removed and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts in your district and that you will accept service of process from the person who filed the original DMCA notice.
  • Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

4. Repeat Infringer Policy

topgservers maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. If a user has been the subject of multiple valid DMCA takedown notices, we reserve the right to disable or permanently remove their account and all associated server listings without further notice.

6. Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability. Please ensure your claim is genuine before submitting a notice.
